Colombia's Proposal

Colombia's new government proposed the removal of 15 Special Mining District resolutions that imposed restrictions on mining activities in several areas of the country. The announcement comes as part of the new Colombian government efforts to attract investments in its mining sector and promote exploration and production activities.

The mining restrictions were imposed by the previous Colombian government and included a total area of 5,340,192 hectares across 11 of the nation's departments in different parts of the country.

The resolution forms part of a broader regulatory effort by the new Colombian government to streamline permits and accelerate processes regarding mining and hydrocarbon projects, following restrictions on extractives under the previous administration.

"This is just a sample of what this Government wants to do; here we are going to eliminate a lot of red tape, we are going to be agile because we are eager to see results," said Colombia's Minister of Mines and Energy, Nohemi Arboleda, about the resolution, as quoted by Rumbo Minero.

The resolution leaves existing mining titles and concessions unaffected. "Rather than harming them, this repeal removes the element of uncertainty that the delimitations cast over them," reads the ministry's resolution.

The proposal does not require congressional approval, but it is under public consultation through September 18, after which it can be finalized by the Ministry of Mines and Energy. Once the resolution enters into force, Colombia's Ministry of Mines and Energy and the National Mining Agency (ANM) will have 30 days to update the mining cadastre, as well as the corresponding information, and mapping.

"Mining districts were intended to organize the territory and support mining regions; however, they were used to displace mining activity. They were poorly designed, which stifled investment and exploration, dealing a blow to small-scale mining and formalization efforts," Arboleda said, as quoted by Rumbo Minero.

Mining Pipeline

According to Industrial Info Resources data, there are 147 Metals and Minerals projects in Colombia, representing investments of US$4.85 billion. Of those, 20 projects have a high probability of completion and include gold, steel, ceramic, and copper projects. Among the biggest projects with a high probability of completion is the San Matias Alacran project, an open-pit copper and gold mine requiring an investment of about US$473.4 million, with a construction period of two years and a mine life of 14.2 years.

This new mining resolution, in addition to efforts to streamline permits, seeks to reduce uncertainty and attract interest in the exploration and exploitation of minerals across the South American nation.

Upcoming Challenges

Despite the government's efforts, Colombia faces challenges in attracting foreign investments and developing its mining industry. Among those challenges is the need to guarantee long-term fiscal and legal stability for capital-intensive mining projects, whose investment and development timelines can extend for years.

At the same time, illegal mining and decades-long conflict with armed groups across Colombia also pose a security risk for companies operating or considering investments in the South American nation.
