Researched by Industrial Info Resources (Sugar Land, Texas)--In the wake of the Dan River coal ash spill, more issues have arisen for Duke Energy Corporation (NYSE:DUK) (Charlotte, North Carolina). The North Carolina Department of Environment and Natural Resources (NCDENR) has issued notices of violation against five more coal-fired Duke Energy power facilities in the state.

The facilities have been cited for lacking the necessary stormwater permits, which are required to release rainwater from plants into public waterways. The five citations are in addition to the two issued at the closed Dan River Steam Station, which released coal ash into the Dan River after a 48-inch stormwater pipe failed.

The five additional facilities are the Belews Creek Power Station in Rockingham County; Cliffside Power Station in Rutherford County; H.F. Lee Steam Electric Plant in Wayne County; Roxboro Steam Electric Power Plant in Person County; and Sutton Steam Electric Plant in New Hanover County.

"Our agency is determined to make sure that all of these facilities are in compliance with state and federal law," said John Skvarla, secretary of the NCDENR. "We're doing everything in our power to prevent environmental disasters like what we've seen at the Dan River. We are committed to protecting public health and the natural resources of our state."

Duke Energy has been given 30 days to react to the new notices given by the NCDENR. In the initial notice, the state has threatened a $25,000-per-day fine for releasing the water without a permit. A dollar amount has not been announced for what the energy provider could potentially be charged under the new set of violations.

Coal ash can contain mercury, arsenic, selenium, and other potentially toxic materials.
