Constitution Pipeline Faces Continued Hurdles in What Could Be a State vs. Federal Showdown
In August, owners of the Constitution Pipeline were disappointed when the U.S. Court of Appeals for the Second Circuit rejected a lawsuit by the owners claiming the New York State Department of Environmental Conservation (NYSDEC) had overstepped its bounds in denying a water-quality permit to the 124-mile pipeline, which is intended to carry natural gas from the Marcellus Shale in Pennsylvania into New York.
